Agreement

These Terms of Use ("Terms") govern your use of the Mixxy mobile application (the "App"), operated by Mixxy ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

Eligibility and Your Account

You must be at least 13 years old to use the App. You are responsible for keeping your login credentials secure and for all activity on your account. Your username is permanent and cannot be changed after registration. You may delete your account at any time from the Profile tab.

Zero Tolerance for Objectionable Content and Abusive Users

Mixxy has zero tolerance for objectionable content and abusive behavior. You may not upload, share, or link to content that:

  • is sexually explicit, pornographic, or exploits or endangers minors in any way;
  • is hateful, harassing, threatening, bullying, or discriminatory toward any person or group;
  • depicts or promotes violence, self-harm, or illegal activity;
  • is defamatory, misleading, or impersonates another person or business;
  • infringes anyone's copyright, trademark, privacy, or other rights, including photos you did not take or do not have permission to share;
  • is spam, advertising, or unrelated to the activity it is posted on.

You also may not use the App to harass other users, attempt to access accounts or data that are not yours, or interfere with the App's operation.

Moderation, Reporting, and Blocking

Every photo you upload is reviewed by us before anyone else can see it, and we may decline to publish any photo for any reason.

If you see a photo that breaks these Terms, tap Report on the photo. You can also choose Report & Block Uploader, which immediately hides all of that user's photos from you. Reports are sent to our team for review. When content violates these Terms, we remove it and may suspend or permanently terminate the account of the user who posted it.

Your Content

You keep ownership of the photos, ratings, and notes you add to the App ("Your Content"). By uploading a photo that is published to other users, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and reproduce it within the App for the purpose of operating the App. Photos that have been published to other users may remain in the App after you delete your account, no longer linked to you, as described in our Privacy Policy. You are solely responsible for Your Content and confirm that you have the rights to share it.

Activity Information

Activity details such as hours, addresses, and descriptions are provided for convenience and may be inaccurate or out of date. Confirm details with the business before you go. Mixxy is not affiliated with or endorsed by the businesses listed in the App.

Advertising and Third-Party Services

The App displays ads and relies on third-party services, as described in our Privacy Policy. We are not responsible for the content of ads or of third-party websites you open from the App.

Termination

We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms or if we believe your use harms other users or the App.

Disclaimers and Limitation of Liability

The App is provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, Mixxy is not liable for any indirect, incidental, special, or consequential damages arising from your use of the App or from any activity you discover through it.

Apple App Store

These Terms are between you and Mixxy, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App after any changes constitutes your acceptance of the updated Terms.
